Terms and Conditions for River Estate Kauai Vacation Rentals
1. Introduction
Welcome to River Estate Kauai Vacation Rentals. By booking with us, you agree to abide by the following terms and conditions. Please read them carefully to ensure a safe and enjoyable stay.
2. Reservations and Payments
Booking Confirmation: Your booking is confirmed only upon receipt of full payment or a specified deposit. A confirmation email will be sent once the payment is processed.
Payment Methods: We accept major credit cards, PayPal, and bank transfers.
Deposit: A 50% deposit is required at the time of booking. The remaining balance is due 60 days before arrival. For bookings made within 60 days of arrival, full payment is required at the time of booking.
Taxes and Fees: All rates are subject to Hawaii general excise tax (4.712%), transient accommodations tax (10.25%), and Hawaii County transient accommodations tax (3%).
3. Cancellation and Refund Policy
Cancellation by Guest:
Cancellations made more than 91 days before check-in will receive a full refund minus a $200 administrative fee.
Cancellations made between 60 and 90 days before check-in will receive a 50% refund minus a $200 administrative fee.
No refunds will be issued for cancellations made less than 60 days before check-in.
Cancellation by Owner: If we need to cancel your reservation, a full refund will be provided. We are not responsible for additional costs incurred due to cancellation.
Force Majeure: No refunds will be provided for cancellations due to force majeure events (e.g., natural disasters, pandemics, travel restrictions).
4. Check-In and Check-Out
Check-In Time: Check-in is from 3:00 PM on the arrival date. Early check-in may be available upon request and subject to availability.
Check-Out Time: Check-out is by 11:00 AM on the departure date. Late check-out may be available upon request and subject to availability.
Identification: Guests must provide valid identification upon check-in.
5. Property Use
Occupancy Limits: The maximum number of guests is specified in the property listing. Exceeding this limit without prior approval may result in eviction without a refund.
Conduct: Guests must conduct themselves in a respectful manner. Excessive noise, illegal activities, or any conduct that disturbs others will not be tolerated.
Damages and Liability: Guests are responsible for any damage to the property during their stay. A security deposit may be required and will be refunded upon satisfactory inspection of the property after check-out.
Pets: Pets are not allowed without prior approval. If approved, additional fees may apply.
Smoking: Smoking is strictly prohibited inside the property. Smoking is only permitted in designated outdoor areas.
6. House Rules
Cleanliness: Guests are expected to maintain the property in a clean and tidy condition. Excessively dirty units may incur additional cleaning charges.
Appliances and Amenities: Use all appliances and amenities responsibly. Issues or failures of appliances do not warrant a refund or compensation.
Key and Access: Return all keys and access devices at check-out. Lost keys or devices may incur additional charges.
7. Liability and Disclaimers
Owner’s Liability: The owner is not liable for any injury, loss, or damage to guests or their belongings during their stay. Guests should ensure they have adequate travel insurance.
Website Accuracy: While we strive to ensure all information on our website is accurate, we are not liable for any errors or omissions. Descriptions and photos are for illustrative purposes and may not reflect the exact appearance of the property.
Complaints: Any complaints about the property or service must be reported immediately. We will address and resolve issues as quickly as possible.
8. Governing Law
These Terms and Conditions are governed by the laws of the State of Hawaii. Any disputes arising from these terms or your stay at River Estate will be subject to the exclusive jurisdiction of the courts of Hawaii.
9. Changes to Terms and Conditions
The owner reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to guests and will apply to bookings made after the date of the change.

The Guest House
Occupancy: Sleeps 4 guests
Features: Luxurious privacy, top quality Balinese hardwood furniture, split system A/C, high-quality mattresses, bedding, and towels.
Amenities: Well-equipped entertainment system with Roku TV, dimmable lighting, open beam living/kitchen ceiling, two bedrooms, two well-appointed bathrooms, large open covered lanai with stream view.
Rates: $400 plus tax per night (standard rate), $425 plus tax per night (holiday rate).
The River House
Occupancy: Sleeps 6 guests
Features: Top quality Tommy Bahama furnishings, solid cherry hardwood floors, split system A/C, dimmable lighting, fine vintage solid wood furniture, authentic vintage Hawaiian art.
Amenities: Riverside dining on the screened main lanai, separate covered lanais for each bedroom, Chinese textured tile floors, large master suite with flat screen TV, three bedrooms, two well-appointed bathrooms.
Rates: $425 plus tax per night (standard rate), $450 plus tax per night (holiday rate).
